Terms and Conditions

Welcome to Secondhand Uniforms. These Terms and Conditions ("Terms") govern your use of our platform. By creating an account, listing, buying, or selling items through Secondhand Uniforms, you agree to comply with these Terms.

1. About Us

Secondhand Uniforms is operated by WAM Software, a limited company registered in the UK ("we", "us", "our"). The platform provides a marketplace for the buying and selling of secondhand school uniforms.

2. Who Can Use the Platform

The platform is intended for UK residents aged 18 or over.

By registering, you confirm you are legally capable of entering into binding contracts.

3. User Accounts

  • All users must create an account via Auth0, our secure authentication partner.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • We reserve the right to suspend or terminate accounts that breach these Terms or behave inappropriately.

4. Permitted Listings

Only school-approved uniform items may be listed. Each school has a defined catalogue of acceptable items. Listings outside this catalogue may require admin approval or be removed.

5. Buying and Selling

All exchanges occur either:

(a) In Person - buyer and seller meet directly, inspect the item, and confirm the transaction on the spot; or

(b) Drop Off Point - seller leaves the item at an agreed location for later collection by the buyer.

  • Exchanges are verified typically using usernames or an exchange number code.

  • Buyers must confirm receipt of the item on the platform.

  • Once confirmed, the transaction is final, and no returns or refunds will be accepted, unless required by law.

  • Buyers must inspect items at the time of exchange and decline the item then if unsatisfied.

6. Payments and Fees

  • Payments are processed via Stripe. We do not have access to your payment details.

  • When a buyer places an order, we pre-authorise the payment. We may send reminder emails before capture. If the buyer does not cancel or confirm within 5 days, we capture the payment and hold it until the exchange is confirmed or the order auto-completes.

  • When the seller confirms drop-off or handover, a five-day completion window begins. If the buyer does not confirm receipt or raise a dispute, we may complete the order after that window. Completion does not automatically transfer a payout.

  • A platform fee is deducted from each sale. A school-specific PTA fee may also apply.

7. Exchange Risk Notice

  • All exchanges, whether In Person or via a Drop Off Point, rely on the buyer confirming receipt of the item in the platform.

  • If the seller confirms handover and the buyer does not respond, we may complete the order after five days. The buyer may confirm receipt or raise a dispute until ten days after the seller's confirmation. An open dispute keeps payouts on hold.

  • Before seller confirmation, either participant may cancel an eligible order. After seller confirmation, only the seller may use ordinary cancellation before completion. Disputes are reviewed individually and do not guarantee a refund.

  • Sellers accept this risk when using the platform.

  • If a seller wants to minimise risk, we recommend choosing In Person Exchange, so buyer confirmation can be completed at the handover.

8. Refunds

  • Buyers may raise a dispute through the order until ten days after seller-confirmed handover. We review disputes individually; raising one does not guarantee a refund.

  • Where a refund is approved, we will process it to the original payment method and cancel related payouts.

  • Statutory rights under UK law (including for misdescription or faulty goods) are not affected.

8. Communication and Newsletters

  • Order and system notifications are sent via email.

  • Users may opt in to receive newsletters and can unsubscribe at any time.

9. Data Protection and Privacy

  • Personal data is securely managed through Auth0.

  • We do not store user data directly.

  • Please review our Privacy Policy for full details.

10. Your Responsibilities

  • You must describe items truthfully and ensure they are clean and in good condition.

  • Misleading listings or fraudulent activity will result in account suspension or removal.

  • You may not use the platform for unlawful, harmful, or inappropriate purposes.

11. Consumer Rights and Refunds

This platform facilitates peer-to-peer sales between individuals. As such, transactions are not covered by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and do not include a 14-day cooling-off period.

Buyers are expected to inspect items during the handover and must reject the item at that point if dissatisfied. Once confirmed, all sales are final.

12. Our Responsibilities and Liability

  • We act solely as a facilitator and do not inspect, approve, or guarantee any items.

  • We are not liable for:

    • Quality, condition, or accuracy of listed items.

    • Non-payment if the buyer fails to confirm a Drop Off transaction within Stripe's timeframe.

  • Any disputes must be resolved between users. We may assist at our discretion but are not obligated to mediate.

13. Termination

  • We reserve the right to:

    • Suspend or terminate accounts for violations of these Terms.

    • Remove or reject listings that do not meet platform requirements.

    • Refuse service where legally permissible.

  • You may delete your account at any time through your user settings.

14. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on our website and become effective immediately. Continued use of the platform constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in UK courts.

16. Regulatory Notice

The platform acts as commercial agent of the seller for the purpose of concluding and receiving payment for sales of second-hand school uniform items.
